Carson City torney General Frankie Sue Del Papa announced today that federal Judge Howard McKibben dismissed a lawsuit filed by Medicaid recipients asking for part of the tobacco settlement being paid by major tobacco manufacturers to Nevada. In November, 1998, Nevada along with 45 other states signed a settlement with the major tobacco manufacturers requiring the tobacco companies to pay 6 billion over the next 25 years to the states. Nevada's share of this settlement is .2 billion. Following the settlement, several Medicaid recipients filed a law suit asking that the State pay part of the settlement payments to them. "This decision confirms the State's right to the tobacco settlement proceeds, " stated Attorney General Del Papa. "The court decided that the Medicaid law provides health care to low income individuals and is not the basis for damage lawsuits against the state." Medicaid is a program jointly funded by the state and federal governments that provides medical care to low income people without other health insurance. Nevada, along with other states, alleged that tobacco use increased the costs of the Medicaid program and sought reimbursement from the tobacco companies for that increased cost. The Medicaid recipients argued that the State recovered more than its medical costs and that additional recovery should be paid over to Medicaid recipients. Judge Howard McKibben dismissed the complaint holding that the Medicaid recipients' lawsuit was for money damages against a state and barred by sovereign immunity. Such lawsuits are prohibited unless specifically authorized by Congress or a state agrees to be sued. Judge McKibben noted that Nevada collected only its tobacco related medical expenses and that the Medicaid recipients could sue the tobacco companies for any other damages.
The Central African States are in the process of ratifying the treaty to establish the Economic Community of Central African States ECCAS ; . In October 1983 ten countries had signed the treaty: Burundi, Cameroon, Central African Republic, Chad, Congo, Gabon, Equatorian Guinea, Rwanda, Sao Tom and Zaire. Their expressed purposes are: abolition of customs duties and removal of quantitative restrictions on intra-community trade; a common external trade policy; abolition of obstacles to the movement of goods, services and capital; a common Co-operation and Development Fund; and joint policies on promotion of industry, transport, communications, energy and other areas of development. The time-table of the new Community calls for implementation of its objectives in three stages over a twelve-year period. Fiscal and customs rgimes would not be altered until the second stage is reached, when a free-trade zone within the Community is targeted. A common external tariff would be adopted during the third stage. The treaty also provides for the establishment of a Council of Ministers which will meet twice a year, a Court of Justice, a General Secretariat, a consultative commission and specialized technical committees of experts.

Objectively, at admission, blood pressure was 86 57 mmHg, the pulse 96 beats per minute, and left lower abdominal tenderness was observed. Laboratory values showed normocytic anemia Hb 11.3 mg dl ; , extremely elevated white cell count with inverted formula, mild renal failure and hepatitis. Analytical evaluation done 6 days previously had shown no evidence of anemia, mild leucopenia and trombocytopenia. Imagiological abdominal evaluation ultrasound and CT scan ; r evealed splenic rupture with local heamotoma and significant haemoperitoneum. He underwent emergent surgical splenectomy. Histopathological examination documented a ruptured non pathologic spleen. Epidemiological context appeared irrelevant, there had been no recent trauma, nor there had been other recent symptoms compatible with infection. Subsequent workup revealed antibodies studies positive for infectious mononucleosis acute EBV infection ; only three weeks after presentation. Spontaneous splenic rupture associated wih infectious mononucleosis is an extremely infrequent ocurrence but a very severe one. It is usually described in children and occurs more often as late complication. Rarely it may be the initial presentation and the seroconversion may be detected later in the course of disease, as in this case report and phenazopyridine.
