As the patent law encourages an inventive entity to file a patent application early, patent applications for biotech inventions may be filed before the full scope of the invention is known. In particular, it takes many years to bring a biologic to market, during which time the compound and its methods of use may be modified in response to clinical trial data. Thus, the continuation practice is important to obtaining a full range of patent coverage for biotechnology inventions, particularly with respect to potential follow-on compounds. The proposed rule is a dramatic departure from current practice, and has the potential to significantly affect the scope of patent coverage for biological products. Any follow-on protein scheme must be considered in light of these proposed changes. 99 XI. The Patent Term Restoration Scheme May Prove to be Too Narrow for Follow-On Proteins A new biological product that undergoes a regulatory review period is eligible for patent term restoration. 100 The period of restoration is intended to compensate the innovator for loss of "effective" patent term due to the time needed to complete the regulatory review of the product. The patent laws encourage an inventor to file a patent application as early as possible, which may occur many years before the product receives marketing approval. As the term of a patent generally runs from the filing date, a significant portion of the patent term may be lost during the regulatory review period for the product. The results showved the presence in all samples of two major components with relative mobilities corresponding to pro-al and pro-a2 chains Fig. 4 ; . The molecular weight of pro-al was estimated at about 125, 000, and the ratio of radioactivity in pro-al to that in pro-a2 was, in all samples, approximately 2 to 1. Control experiments showed that when [3H]glucosamine alone was carried through these procedures, essentially all of the 3H eluted with carrier glucosamine; none eluted with galactosamine. The total recovery of 3H from the amino acid analyzer was greater than 90%. For the [3H]mannose-labeled material, about 90% of the 3H eluted from Dowex in the water effluents. Upon ion-exchange chromatography, greater than 90% of the recovered 3H cochromatographed with carrier mannose. However, the total recovery of 3H from the borate column was only 5075%. The remaining radioactivity was not eluted in the gradient nor with the 10% potassium borate-0. 1% EDTA used to wash the column. Identical results were obtained with standard [2-3H]mannose. While we have no explanation for this observation, it is important to note that the label from [2-3H]mannose should be lost upon conversion of mannose to other neutral sugars or amino acids through the phosphomannose isomerase reaction 27 ; . A small amount of radioactivity from [2-3H]mannose may, however, appear in fucose; but we did not detect this and glycopyrrolate.
